Meeting Financial Requirements & Adequate Maintenace Requirements for Family Visa Applications

Applying for a UK visa, whether as a partner, parent, or child, can be a daunting process, especially when it comes to meeting the financial requirements.

Minimum Financial Threshold:

On 11 April 2024, the financial requirement an applicant or their partner has to meet from employment or non-employment income, was increased to from £18600 in annual gross income to £29000. There is another increase expected in early 2025 to  £34,500.

For savings, this also increased from £62,500 to £88,500. With a possible increase in early 2025 to £ 102,250.

Good news for those already on the 5-year route or applied for a fiancé(e) visa before 11 April 2024 is that they will continue to meet the £18600 income threshold or £62,500 in savings throughout their visa route.

Adequate Maintenance:

Means that, after income tax, National Insurance contributions and housing costs have been deducted, there must be available to the family the level of income that would be available to them if the family was in receipt of Income Support.

Adequate maintenance and accommodation, in the context of UK family visas, refers to the ability of the sponsor (the UK resident or settled person) to financially support and accommodate their family member(s) who are applying for a visa to join them or remain with them in the UK.

Sources For Meeting the Financial Requirement

  1. Employment Income: Income from salaried or non-salaried employment of the partner (and/or the applicant if they are in the UK with permission to work).
  2. Non-employment Income: for example, income from property rental or dividends from shares.
  3. Cash savings:  of the applicant’s partner and/or the applicant, held by the partner and/or the applicant for at least 6 months and under their control. There are various ways to meet the cash savings, e.g., cash gift from friends and or family, net sale of rental property, amongst others.
  4. Pension: State (UK or foreign), occupational or private pension of the applicant’s partner and/or the applicant.
  5. Self-Employment: Income from self-employment, and income as a director or employee of a specified limited company in the UK, of the partner (and/or the applicant if they are in the UK with permission to work)

Some sources of income can be combined to meet the requirement.

ADEQUATE MAINTENANCE:

The sponsor must be in receipt of at least one of the following benefits:

  • Disability Living Allowance
  • Severe Disablement Allowance
  • Industrial Injury Disablement Benefit
  • Attendance Allowance
  • Pension Age Disability Payment (Scotland)
  • Carer’s Allowance
  • Personal Independence Payment
  • Adult Disability Payment (Scotland)
  • Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme
  • Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme
