If you want to get married and live permanently in the UK with your British citizen partner or someone settled in the UK, an Irish citizen living in the UK, or an EEA national with settled status or pre-settled status, the fiancée/fiancé visa is the route to take. This visa allows you to enter the UK to be married to your partner and then apply for a spouse visa, in-country.

If you are already married, or an unmarried partner, you can make the spouse visa or unmarried visa. All these visas are the Partner visas under the Family visa category.

These routes allow you to enter and remain in the UK with your partner, parent, child or children. After 5 years, or 10 years, depending on which you qualify for, you would be able to apply for settlement.

Short-term & Long-Term work visas that do not lead to Settlement: Can stay in the UK for maximum period from 6 months in any 12 months period up to 9 years in a 10-year period depending on the route.

After completing a period of  3, 5 ,10, and by April 2026, 20 and 30 years, you may qualify to apply for Indefinite Leave to Remain in the UK, otherwise known as Settlement. 

You will need to have passed the knowledge of Life in the UK and meet the English language requirement. You also need to be of good character and meet the residency requirement.

Under some routes, if you have been outside the UK for a period of more than 180 days in any 12 months period, you would not qualify to apply for settlement.

For some, applying to become a British citizen is their dream and the last stage in their immigration journey in the UK.

You can apply to become a British citizen after 5 years in the UK and after you have obtained Settlement in the UK.

To become a British citizen, you can either be British automatically at birth or make the following applications:

  1. For those 18 years and above.
  2. For children and certain categories of adults

1. NATURALISATION

To apply for naturalisation, means to apply for British Citizenship as an adult, you must be 18 years and above and have lived in the UK for 5 years. 3 years if married to a British citizen. You also need to have held indefinite leave to remain (ILR), that is, free from immigration time restrictions for 12 months if not married to a British citizen, and if married to a British citizen, you can apply immediately you have obtained ILR.

If you are not married to a British citizen, it means, in most cases, you would have been in the UK for 6 years before making an application.

You also need to meet the residency requirement of not having spent 450 or 270 days outside the UK for the 5-year residency if you are not married to a British citizen or 3 years if you are married to a British citizen. In the 12 months before making your application, you should not have been outside the UK for more than 90 days.

You also need to be of good character, be of sound mind to know what you are doing, not breached immigration rules and not have any serious criminal convictions. You also need to meet the English Language requirement and have passed the Life in the UK test. In some routes to ILR e.g., EU nationals applying of Settled Status, you would not have needed to demonstrate Knowledge of language and life in the UK, but for naturalisation this is now required.

You must demonstrate both knowledge of language and life in the UK unless you are aged 65 and over or have a long-term physical or mental condition that prevents you from doing so.

The legal requirements you should meet before you apply are that you:

  • Are aged 18 or over when you apply.
  • Are of sound mind, so that you understand the step you are taking.
  • Have lived in the UK for a minimum of 5 years before you apply (3 years if married to a British Citizen).
  • Must have been physically present in the UK (including the Isle of Man or the Channel Islands) on the day 5 years (3 years if married to a British Citizen) before the application is received by the Home Office.
  • Must not have been in breach of the immigration laws in the 5-year period before making your application. We may assume you meet this requirement without. making further enquiries if you have been granted indefinite leave to enter or remain in the UK.
  • Must be free from immigration time restrictions on the date of application and for the 12-month period before making the application. (The 12-month period does not apply if married to a British Citizen)
  • Must not have had more than 450 days (270 days if married to a British Citizen) outside the UK in the 5-year period (3 years if married to a British Citizen) before making the application.
  • Must not have had more than 90 days outside the UK in the 12-month period before making the application (but see the section on Absences from the UK).
  • Intend to continue to live in the UK, or to continue in Crown service, the service of an international organisation of which the UK is a member, or the service of a company or association established in the UK.
  • Have passed the Life in the UK test.
  • Can communicate in English (or Welsh or Scottish Gaelic) to an acceptable level
  • Are of good character

2. REGISTRATION

a) Child under 18

Children under 18 years old can apply for registration if they qualify. There are various ways a child qualifies to register as a British citizen and in some cases, the child is British automatically at birth.  Depending on where and when the child was born, the child may qualify to register as follows:

  • birth in the UK to parents who are now settled in the UK or have become British citizens.
  • birth in the UK to parents who have joined the armed forces.
  • child whose parents are applying for British citizenship.
  • birth abroad to parents who are British by descent and have lived in the UK or a qualifying British overseas territory.
  • birth abroad to parents who are British by descent but are now living in the UK or a qualifying British overseas territory.
  • birth abroad to parents serving in the armed forces.

b)  UKM

This is for those born outside the UK before 1 January 1983 to British mothers. At that time British mothers could not pass on British citizenship to their children born outside the UK. It does not matter how old you are or what country you currently live at the time of application.

This is for those born before 1 July 2006 to British fathers. At that time British Fathers could not pass on British citizenship to their children if the child’s parents were not married at the time of birth.
